Cliff-Cartwright Corp and/or its affiliates (“Cliff-Cartwright”, “we”, “us and “our”) provide website features and other products and services to you when you visit or shop at www.TEAMHOTSHOT.com (“Website”), use Cliff-Cartwright’s products or services or use Cliff-Cartwright’s mobile/tablet applications (collectively, “Services”). Cliff-Cartwright provides the Services subject to the following conditions.
While Cliff-Cartwright uses reasonable efforts to include accurate and up to date information in connection with the Services, we make no representations or warranties as to the accuracy, correctness, reliability or otherwise with respect to such information, and assume no liability or responsibility for any omissions or errors (including without limitation typographical errors and technical errors) in connection with the Services.
ACCESS AND USE
(i) remove, alter, cover, or distort any copyright, trademark, or other proprietary rights notice we include in or through our Services or Service Content;

(xi) engage in any conduct that restricts or inhibits any other user from using or enjoying our Services.
USER REGISTRATION & PROMOTIONAL MESSAGES

Terms of payment for the products are within Cliff-Cartwright’s sole discretion. Payment for the products will be made by credit card. The contract for sale of goods between us and any customer is not entered into until we charge a valid credit card. The posting of prices on our Website is not an offer for sale of goods, and the order confirmation is not an acceptance of an offer to purchase goods. We generally charge your credit card once your order has been accepted.
You agree to provide current, complete and accurate purchase and account information for all purchases made on our Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You are responsible for sales and all other taxes associated with any order to purchase our products, however designated, except for taxes on Cliff-Cartwright’s net income.
Products; Not for Resale
Cliff-Cartwright’s policy is one of on-going product update and revision. Cliff-Cartwright may revise and discontinue products at any time. Cliff-Cartwright reserves the right to limit order quantity at any time without notice. Prices and promotions are subject to change without notice, at our sole discretion. You agree and represent that you are buying for your own internal use. If you wish to purchase any product for resale please contact Cliff-Cartwright at info@TeamHOTSHOT.com. Because customer service is paramount to our business, we reserve the right to refuse to sell products to you if it reasonably appears to us that you intend to resell the products. In addition, we reserve the right to limit quantities of items purchased by each customer. In addition, we reserve the right to cancel any order or part of an order, or refuse service to anyone for any reason. Such reasons may include, but are not limited to, unauthorized coupon use, product availability, price discrepancy or pricing error. We also reserve the right to change the terms of any offer or promotion at any time without notice.
RISK OF LOSS
All items purchased from Cliff-Cartwright are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to you. In the event that your product is damaged during shipment, Cliff-Cartwright will replace the product at no charge. Please contact Cliff-Cartwright within 4 days of receipt of product at info@TeamHOTSHOT.com if such damage occurs.
When you use any Service, including purchasing any product, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you in a variety of ways, such as by e-mail, text, in-app push notices, or by posting notices and messages on this site or through the other Cliff-Cartwright. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

(vi) contains a formula, instruction, or advice that could cause harm or injury.
Moreover, any conduct by a user that in our sole discretion restricts or inhibits any other user from using or enjoying our Services will not be permitted.
(E) Notwithstanding the generality of the foregoing, we reserve the right to display advertisements in connection with your User Content and to use your User Content for advertising, marketing, promotional, and other commercial purposes. You acknowledge and agree that your User Content may be included on the websites and advertising networks of our distribution partners, marketing partners, accounts, and third-party service providers (including their downstream users).
(F) We have the right, but not the obligation, to monitor User Content. We have the right in our sole discretion and for any reason whatsoever to edit, refuse to post, remove, or disable access to any User Content.

LIMITATION ON LIABILITY
(C) In some jurisdictions limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitations may not apply to you. These limitations shall apply to the fullest extent permitted by law.

CHOICE OF LAW; JURISDICTION AND VENUE;
NO CLASS ACTIONS
TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASSWIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY, OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION OR OTHER PROCEEDING.
NO TRIAL BY JURY
TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LAWSUIT, ARBITRATION OR OTHER PROCEEDING.
AMENDMENT; ADDITIONAL TERMS
(A) No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
